NYS Standard Operating Procedure

Under New York Real Property Law §442-H, every real estate broker in New York State must adopt and publicly post a Standardized Operating Procedure describing the prerequisites, if any, that prospective buyers and renters must meet before receiving services from the brokerage.

The Standardized Operating Procedures of Gold Coast Homes & Estates are as follows:

  1. Identification: Prospective buyers and renters are not required to show identification to work with a Gold Coast Homes & Estates agent. Identification may still be required to enter a specific building, attend a showing, or attend an open house where a seller, landlord, managing agent, sponsor, or building security requires it.
  2. Exclusive Broker Agreement: An exclusive brokerage agreement is not required for a buyer or renter to work with a Gold Coast Homes & Estates agent.
  3. Pre-Approval / Proof of Funds: Mortgage pre-approval or proof of funds is not required before working with a Gold Coast Homes & Estates agent. A seller, landlord, or listing agent may still require proof of funds or pre-approval before scheduling a showing or accepting an offer on a specific property.

Individual property owners remain free to set their own qualifying criteria for a specific listing, provided that criteria is established in advance, applied uniformly and objectively to all prospective buyers or renters, and is non-discriminatory.
